Terms of Service

Welcome to Westside Property Management. By booking accommodation through our website (https://westsidestay.com), you agree to comply with the following Terms of Service. Please read them carefully before completing your reservation.

1. Booking & Payment

1.1. Full Payment Required – All bookings must be paid in full at the time of reservation. Partial payments or deposits are not accepted.

1.2. Credit Card Authorization – By completing a booking, you authorize Westside Property Management to charge the full amount to your provided payment method.

1.3. Pre-Check-In Verification – We may require additional identity verification, including but not limited to a government-issued ID and credit card verification before check-in. Failure to comply may result in the cancellation of your reservation without a refund.

1.4. Non-Refundable Policy – All bookings are strictly non-refundable, regardless of cancellation, modification, early departure, no-show, or other circumstances. However, this policy does not override your rights under the Australian Consumer Law. If the accommodation or services fail to meet consumer guarantees, you may be entitled to remedies such as a refund, repair, or replacement.

2. Chargebacks & Disputes

2.1. No Chargeback Policy – By booking with us, you agree not to dispute or chargeback the transaction for any reason. All disputes should be resolved directly with Westside Property Management.

2.2. Proof of Stay & Payment – We maintain check-in records, electronic key access logs, and other documentation to verify guest stays. In the event of a dispute, these records will be submitted to the payment processor or financial institution as evidence.

2.3. Fraudulent Disputes – Unauthorized chargebacks or false claims may result in legal action, additional fees, and being reported to fraud prevention databases.

3. Security Deposit & Damages

3.1. Incidental Charges – We reserve the right to charge your payment method for any damages, excessive cleaning fees, or policy violations incurred during your stay.

3.2. Deposit Hold – A security deposit hold may be placed on your payment method before check-in. The hold will be released after check-out if no damages are found.

4. Guest Responsibilities & House Rules

4.1. Compliance with Property Rules – Guests must comply with all property rules, building regulations, and local laws.

4.2. Occupancy Limits – The number of guests must not exceed the limit stated in your booking. Unregistered guests are not permitted.

4.3. Noise & Disturbances – Excessive noise, parties, or disruptive behavior will result in immediate eviction without a refund. Note that recent legislative changes in Victoria empower owners corporations to take action against short-stay occupants causing disturbances.

4.4. No Smoking, No Pets – Unless explicitly stated, smoking and pets are strictly prohibited. A violation may result in additional cleaning fees.

5. Compliance with Victorian Regulations

5.1. Short-Stay Accommodation Levy – From 1 January 2025, a 7.5% levy applies to short-stay accommodations in Victoria. This levy will be added to your booking total, including fees and charges such as cleaning fees and GST, where applicable.

5.2. Owners Corporation Rules – Be aware that some properties may be subject to owners corporation rules that could restrict or prohibit short-stay accommodations. It is your responsibility to ensure compliance with such rules.

6. Liability & Indemnification

6.1. Guest Assumption of Risk – You acknowledge that your stay is at your own risk, and Westside Property Management is not responsible for accidents, injuries, loss, or theft of personal belongings.

6.2. Indemnification – You agree to indemnify and hold Westside Property Management harmless from any claims, liabilities, damages, or expenses arising from your stay.

7. Legal Jurisdiction & Governing Law

7.1. Jurisdiction – These terms shall be governed by the laws of the State of Victoria, Australia. Any disputes shall be resolved exclusively in the courts of this jurisdiction.

7.2. Agreement to Terms – By booking with us, you acknowledge that you have read, understood, and agreed to these Terms of Service.
